Epay User Agreement
This agreement will take effect on 22th, Aug, 2018. Welcome to use Epay! Please be sure to read this agreement carefully! This Agreement is a
contract between you and Epay Global Limited (also "Epay", "we") that restricts the use of all Epay services by users
(hereinafter also referred to as "you"). This agreement explains Epay's guidelines for providing services and confirms the rights and obligations of
users when using the service. When choosing whether to use Epay services, please be sure to read this agreement carefully and ensure that you understand
the relevant terms and conditions. By creating an Epay account and/or using Epay services, it means that you accept all the terms and conditions of
and Anti-Money Laundering Rules. . Epay may amend this Agreement at any time and the amendments will be made by posting a revised version on the
Epay website. The revised version will take effect when we publish on the Epay website. Epay provides a payment service. You are solely responsible
for understanding and complying with any and all laws, rules and regulations relating to the use of Epay Services in your jurisdiction. Once all
transactions are completed, they cannot be revoked or reversed, you must make trading decisions carefully. In certain transaction types, if a payment
received in your account is refunded or invalid due to other reasons, the payment may be revoked afterwards. This means that you provide goods or
services to your purchaser, the payment may be revoked from your account (refund). If (a) you violate this Agreement or any other agreement you have
with Epay, or (b) an incident of misappropriation, fraud, hacking, etc. that we believe may be harmful to Epay and the security of the user's account,
we may unilaterally stop, Suspend or limit your access to the account or Epay service and/or limit your use of funds.
Tips for you:
1. You understand that Epay is only used as a payment service. This website does not participate in any of your transactions.
Epay is not an issuer of any digital currency and will not have any impact on their growth, bankruptcy or redemption. It does not have any control over the products or services that use Epay to make payments,
so you should be cautious to judge the authenticity, legality and validity of the relevant digital assets and / or information, and bear
the responsibility and loss arising therefrom.
2. Any comments, messages, discussions, analysis, prices, recommendations and other information of Epay are general market commentary and do not
constitute investment advice. We do not assume any loss arising directly or indirectly from relying on this information, including but not limited
to any loss of profits.
3. The contents of Epay are subject to change without prior notice. We have taken reasonable measures to ensure the accuracy of the information on
the website, but we cannot guarantee the accuracy of the information. We will not bear any losses due to this website or the failure to link,loss
caused directly or indirectly by delays or failures in connection with the Internet, transmission or receipt of any notices and information.
4. There are also risks associated with trading systems using the Internet, including but not limited to software, hardware and Internet link failures.
Since Epay cannot control the reliability and availability of the Internet, Epay will not be held liable for distortion, delays and link failures.
5. https://www.epay.com is the only official external information publishing platform;
6. It is forbidden to use Epay to engage in all illegal trading activities or illegal acts such as money laundering, smuggling, commercial bribery, etc.
If any illegal transactions or illegal acts are found, the site will adopt various means, including but not limited to freezing accounts, notifications.
Epay does not assume all responsibility arising therefrom and reserves the right to pursue liability with the relevant parties.
7. It is forbidden to use Epay to conduct malicious manipulation of market, improper transactions and other unethical trading activities.
If such incidents are found, Epay will warn, restrict transactions, and shut down all unethical behaviors such as maliciously manipulated prices
and maliciously affected trading systems. Epay does not assume all the responsibility arising from the preventive protection measures such as the
suspension of accounts and reserves the right to pursue the responsibility of the relevant parties.
8. Digital currency (Cryptocurrency) transactions are highly risky. There may be risks such as the collapse of the digital asset market at any time for any reason, the bankruptcy of digital currency or the inability to redeem fait. You have fully understood that this investment may result in partial or total loss, so Epay shall not be responsible for any discretion and determination of its own financial position, any decision to buy or sell digital currency should bear all losses arising therefrom.
1. Services Of Epay
1.1 Epay offers payment services to users. At the same time, in order to help users use the payment service easily, Epay also provides a
series of auxiliary functions such as recharge, withdrawal and currency exchange.
1.2 While using the service of Epay, you should be aware of:
(i) Epay is not a bank;
(ii)The account of Epay is not protected by any government agency;
(iii) Epay is not regulated by the bank's corresponding
(iv) Your Epay account balance is not a deposit or investment, it does not generate interest or other income.
(v) If you have a balance, Epay will deposit your funds into a summary account separate from its company funds and will not use your funds f
or operating expenses or any other company expenses. In the event of bankruptcy, Epay will not provide your funds actively to its creditors.
(vi) For Epay on behalf of your funds, you promise to waive any interest generated by the funds.
1.3 Epay service providers include Epay Global Limited and its subsidiaries, affiliates and its service organizations.
1.4 User Classification: Epay users can be individuals or businesses.
(i) The System, shall mean the processing system with which Epay provides services to you, including the PC and mobile versions.
(ii) Types of User's Account。Member Account is the common account created by your register, you can login your Member Account via
your e-mail address or telephone number linked to it.
(iii)The fund account is the primary account used for the transaction, and the funds are the account balance.
(iv) Lucky Money is an instrument (in the form of a character string or URL) for sending money to others anonymously and easily.
The instruments could be propagated freely outside Epay. They are usually used for promotion or social purpose， and are divided into normal
Lucky Money and Social Lucky Money. The receivers of Lucky Money could collect them after login their Member Account.
(v) Password is a string composed by a series of intricate characters only known by the user himself for login or payment.
It is a mechanism of authentication agreed between you and Epay.
(vi) Fees are the service fees you paid to Epay for the using of Epay services.
(vii) Commission is the money you obtained from Epay when you recommend Epay to your friends.
1.6 Service type:
(i) Global remittance, through the leading blockchain technology, Epay connects global merchants, remittance companies and users through network technology, and utilizes technology innovation on the basis of local payment and cross-border settlement of remittance companies to fulfill merchants, remittance companies and users. Cross-border remittances.
(ii)Pay online, is to send money to someone else.
(iii)Receive money, is to obtain money from another user.
(iv) Secured transaction, is a function based on Epay to resolve credit issues in both parties. Epay as an intermediate guarantor secure transactions between the parties without charging procedure fee.
(v)Lucky money, is to create or receive lucky money,
(vi)Deposit, is to transfer funds from the outside of Epay into your Member Account.
(vii) Withdraw, is to transfer funds to the outside of Epay from your Member Account（bank or the other platform）.
(viii) Exchange, is convert one currency into another through Epay according to certain exchange rate.
1.7 Transaction Currencies, you can transact with USD, GBP, HKD，JPY and EUR 。Besides，cryptocurrencies like BTC、ETH、USDT、EOS、BCH、LTC、
XRP also are supported。
2. User Qualification and Identification
2.1 You must be an adult (above 18 years old, or the age of majority in your judicial district) or a company. You must fill in your account
your resident country or district correctly, and make sure that your judicial district permit relevant transactions.
2.2 You must be the actual beneficiary of the Account, having the rights, taking the responsibilities, and you should act on behalf of yourself
2.3 You must give your information correctly to Epay for the creation of your account and the use of Epay services. You authorize Epay to
do any necessary query (directly or through third parties) to verify your identity. These could include requiring more of your information
or documents, your ID number, requiring you to do something to verify your e-mail address or your ownership of financial instruments, requiring
to check your credit report or to compare with database supplied by third parties or other resources in order to verify your information.
You also consent to Epay obtaining your personal and/or business credit report from a credit reporting agency at account opening, and whenever
we reasonably believe there may be an increased level of risk associated with your account.
2.4 If your ID card expires, you should change your identity information in time or we could require you to renew your ID information or d
ocuments when they expire.
2.5 Closing an Account
Epay will not close any account according to our own wish.
You can apply to close your Member Account, it is unable to be recovered once the account is closed. You must act with prudence.
All the transaction data will be cleared when the account is closed, and you are the one to be responsible for all transactions you did.
You must withdraw all the money in your account before closing it, or you have to declare waiving by express.
3. Contact Information
3.1 You could use an e-mail address or the number of your mobile phone to sign up a Member Account. You will need to enroll an e-mail address
at your first logging-in if you sign up with a mobile phone number. Besides, the e-mail address is the major approach with which Epay will
contact you. The e-mail address will not able to be altered after enrolling, you have to make a deliberate choice on which one to be used.
3.2 You are responsible for your contact information to be correct and effective, so that Epay could get to you without unnecessary limitation.
You understand and agree that if your failure to receive the electronic information sent by Epay is caused by the incorrect or expired e-mail
address or the prevention of your e-mail service provider, or other reason of your own, it should be deemed as that Epay has sent them
successfully and effectively. Please note, if you set a Spam Filter to prevent or transmit e-mails from senders who are not in your contact list,
you must add Epay into your contact list.
4. Specific Rules
You acknowledge, we are not responsible for and have no power to control the goods or services paid via Epay. We don't guarantee that the
buyer or seller with whom you transact will finish the transaction. You have to solve by yourself the potential or existing disputes
with your counterparty, Epay as a payment service provider is not involved with those disputes.
4.1 Pay Online
4.1.1 You could use Epay Pay Online to purchase goods or services, or to send money to your families or friends. The transaction will be finished
and irreversible when the money is received by the payee.
4.1.2 By selecting Epay as the payment method on the merchants' website, you could do the payment with your Epay Account. And you can transfer
funds to a third party by logging-in your Epay Account directly.
4.1.3 Specific rules for payment using Epay account
(i) If payee already has an Epay account, the funds will arrive at payee's Epay account when you submit the payment, and the transaction
will not be revoked once completed.
(ii) If payee has no Epay account, you could send money to his e-mail address. He could accept or reject your payment after account opening with the e-mail address, you could cancel the payment before he makes the choice and the funds will be returned back to your account.
(iii) You can create a payment to one or more payees at once .
(iv) It will deduct your Epay balance when you use Epay Pay Online service.
4.2 Receive Money
4.2.1 You could use Epay services to collect funds for goods and services, or to accept money from your families or friends.
4.2.2 The payments will reach your account when they are submitted after your opening of the account. If some payments are sent to you before the account opening, you as a payee could choose to accept or reject it.
4.2.3 The System will open a sub-account of the currency automatically for you at the same time of your receiving if you don't have that currency before.
4.3 Lucky Money
4.3.1 Normal Lucky Money
(i) Normal Lucky Money exists in the form of a string of characters, which is used to activate the money. You could create a normal Lucky Money and send the string to anybody. They could activate the normal Lucky Money and receive the money by entering the string in the designated field of their Member Accounts. You and the receiver each are not able to know the other.
(ii) To create and send a normal Lucky Money
While creating a normal Lucky Money, you could set the amount, currency, number, allocation model ("random amount" or "fixed amount") and the deadline to activate it. The total amount and Fees will be deducted from your Epay balance when it is created. The funds of the Lucky Moneys that haven't been activated will be returned to your account after the deadline.
You could distribute the normal Lucky Money string via community forums, e-mails and short massages to anyone you like, and you could transmit it when you receive one.
(iii) To receive a normal Lucky Money
You could activate a normal Lucky Money and receive the money in it by entering the string of characters in the designated field of your Member Account before the deadline, then the money will be added into your Account Balance. The number of Lucky Money is limited and you should activate them as soon as you receive the string. One normal Lucky Money is able to be activated only once by one Member Account.
4.3.2 Social Lucky Money
(i) Social Lucky Money exists in the form of a web link, it will help you to get new customers and enliven your website. You could create a Social Lucky Money and paste the web link to anywhere you like as your own website or community forums for promotion. Others could browse your business when they submit to receive the Lucky Money. The receiver is anonymous to you.
(ii) To create and send a Social Lucky Money
While creating a Social Lucky Money, you could set the amount, currency, number, allocation model ("random amount" or "fixed amount") and the deadline to activate it, and you could put some descriptions of your business. The total amount and Fees will be debited to your Balance Account when it is created. The funds of the Lucky Moneys that haven't been activated will be returned to your account after the deadline.
(iii) To receive a Social Lucky Money
You could activate a Social Lucky Money and receive the money in it by clicking the web link after logging in your Member Account before the deadline, then the money will be added into your Account Balance. They are limited and you should activate them as soon as you receive the web link. One Social Lucky Money is able to be activated only once by one Member Account. If you haven't a Member Account yet, you need to open one first.
To use Epay services, you could deposit money in your Member Account through our partner channels.
4.4.1 At present, Epay's recharge cooperation channels include remittance, electronic money platform, and cryptocurrency. For different channels of cooperation, you may be required to pay different channel service fees and Epay fees.
4.4.2 When using the international wire transfer method to deposit, you need to fill in the bank account information of your remittance and go to the bank for remittance operation when you place the order. Please ensure that the bank account information filled in is consistent with the bank account actually remitted, otherwise Epay may rejecte your deposit request.
4.4.3 When using the remittance method to deposit, if you do not want to deposit after you create the recharge order, you can not do the actual remittance. If you regret after the remittance, you can withdraw the cash after the replenishment order is completed.
You could withdrawal Epay balance through our partner channels
4.5.1 Our partner channels include remittance merchants and some internet payment systems. You may have to pay different fees to the service providers and Epay when you choose different withdrawal methods.
4.5.2 When you submit the withdrawal order, the cash withdrawal amount and related fees will be deducted from your Epay balance. Please check the bank account information for withdrawal carefully, if a processing failure is caused by your incorrect bank account information, the amount of withdrawal will be returned to your Account Balance, but you will have to be responsible for the fees charged by the merchants and Epay. If the funds are sent to the wrong person because of your incorrect bank account information, you will have to be responsible for the loss.
4.6 Currency Exchange
In order to make sure the convenience of your payment, Epay will offer you a currency exchange service. The rate for exchange is based on the
exchange rate instantly published by the market, please focus on the change situation of the exchange rate, once you submit the request for currency exchange, it means that you have agreed with the exchange according to the rate we offer.
4.7 About the API
The API provided by Epay include the interface for payment、receivable、check of the balance and check of the transaction record ，you can download related interfaces on the website of Epay （https://www.epay.com/cn/apis.htm）for using them in your website or other applications.
4.8 The compensation for arrears
4.8.1 If you are in default on the fund of Epay and its attached companies, Epay has qualification to deduct the money on your account for any fund you defaulted.
4.8.2 If the balance of your account is negative, Epay has qualification to deduct the money you save or receive for compensating the debt.
4.8.3 If you have more than one type of currency in your account, and one of the them become negative because of some kind of reasons, Epay has qualification to use another type of currency in your account to compensate the debt.
4.8.4 If you establish several accounts, Epay has qualification to deduct the money in one of them to compensate the negative account.
4.8.5 Based on the law, or if Epay receives the court decision that a certain amount of balance should be transferred from merchant's Epay account to user's account, and if the balance becomes minus after deleting the required amount, then merchant's newly deposit balance will make up for the minus.
4.9 Global remittance:
4.9.1 The remitter places the order, submits the information of the remitter and the payee, and can choose the appropriate payment method, the merchant provides the local bank transfer or the offline business outlet; when the order is placed, the matching merchant with the remittance currency in the platform is matched. If the match fails, the order fails;
4.9.2 After the order is successfully placed, the remitter must remit the remittance information provided by the Epay remittance merchant according to the order, and upload the real and effective remittance voucher in Epay; if the remittance information is wrong, the remittance cannot be completed, and the revocation can be cancelled. Cancel the order, or request the remittance institution to change the remittance information through the abnormal function operation of the remittance account; after the order is successfully issued, Epay will freeze the EUSD assets (including the receipts of the receiving institution and the remittance institution) of the equivalent order amount of the remittance institution until the transaction is cancelled and completed. The corresponding EUSD assets will be thawed and settled and sent to the corresponding collection agency and remittance agency asset account;
4.9.3 After the remittance party completes the remittance, it needs to wait for the remittance agency to check the remittance information; if there is an error in the remittance information, the remittance agency has the right to submit the appeal request and submit the appeal materials, and Epay will conduct the transaction arbitration; In case Epay cannot arbitrate the transaction, both parties shall submit their disputes to the judicial organ, and Epay shall be subject to the effective final judicial document.
4.9.4 After the remittance agency confirms the remittance, Epay notifies the co-receiving agency to make payment to the payee; after the payment institution pays the payment to the payee, it will submit a real and valid remittance voucher to the payee through the payment operation, waiting The remitter confirms; the receiving institution can refuse to pay the payee by canceling the operation, Epay will rematch the other paying institutions to continue the transaction, if there is a match failure, Epay will ask the remittance agency to return the remitter's remittance amount and close the order. ;
4.9.5 After the payment institution completes the remittance, it needs to wait for the remitter to check the remittance information. After the remittance confirms the remittance information, the order is completed;
4.10 Secured Transaction
4.10.1 The originator and recipient want to make a deal offline;
4.10.2 The originator first creates a secured transaction on the Epay platform for payment.
4.10.3 After Epay receives the secured transaction, it freezes the assets of the originator account and notifies the payee that there is a secured transaction;
4.10.4 After the transaction is completed by the originator and the payee, the originator confirms the payment on the Epay platform and the transaction ends.
4.10.5 The initiator or payee may continue to freeze the guaranteed funds in case of disputes, and submit relevant materials to request Epay to continue to freeze it. Both parties shall promptly submit their disputes to the judicial organ, and Epay will judge the ownership of the frozen funds with the effective final judicial document.
5. The limitation for transaction
In order to protect the safety of users' accounts and control the risk probably existing in law and credit, Epay might monitor your manners of
transaction, and set up limitation of amount、times and frequency for transaction. You have obligation to know and agree the supervision and
limitation set up by Epay. If the situation happens like:
(a) Betray this agreement or other agreements between you and Epay or
(b) Theft, frauds, hacker attack and other events we considered that possibly is harmful to Epay and the safety of users,
we are able to stop, pause and limit your visit to your account and Epay including use of the money. If you agree, Epay can set up any
necessary limitation for your account without any notice. Under such a situation, Epay would not assume any responsibility for compensation.
6. Recommending Awards
By recommending the Epay service to your friends, you can get a referral reward from Epay. Each Epay account has a referral ID. If your
friend fills in your referral ID when registering for an Epay regular member account, you have completed the recommendation. You can get a
certain percentage of the reward for the handling fee incurred by him and his directly recommended Epay general membership account transaction.
The bonus will be paid to your account balance directly. To make it easier for your friends to sign up, you can also send a referral link
from your account to them.
7. Our Cooperation Channels
7.1 Deposit Channel
At present, Epay supports recharge methods including remittance, electronic currency and crypto currency. Supported remittance deposit
channels are international wire transfers; supported electronic money deposit channels include Perfect Money, Fasapay, Payeer and AdvCash;
supported crypto currency deposit methods include BTC, ETH, USDT, EOS, BCH, LTC and XRP.
7.2 Withdrawal Channel
At present, Epay supports withdrawal methods including remittance, electronic currency and crypto currency. Supported remittance
withdrawal channels are international wire transfers; supported electronic money withdrawal channels include Perfect Money, Fasapay,
Payeer and AdvCash; supported crypto currency withdrawal methods include BTC, ETH, USDT, EOS, BCH, LTC and XRP.
8. User information and security
8.1 How we use your information
Epay's primary purpose in collecting user information is to provide you with a safe, fluid, efficient, and personalized experience.
We may use your personal information for the following purposes: a. Provide Epay services and customer services, process transactions and
send you transaction notifications; b. Verify your identity, including verification during account creation and password reset; c. Resolve
disputes, collect fees and resolve difficult issues; d. Manage risks, detect, prevent and/or repair fraud or other potentially prohibited or
illegal activities; e. Detect, prevent or correct violations of policies or user agreements; f. Improve Epay services by personalizing your
user experience, evaluate Epay service performance and improve its content and layout; g. Manage and protect our information technology
infrastructure; h. Provide targeted marketing and advertising, provide Service update notifications and offer promotional offers based on
your communication preferences.
8.2 Information storage
Wherever our company locates in all over the world, our computers will save and process your personal information. We protect your
information by physical, technical and administrative arrangements, to lower the risks of lost, misuse, unauthorized access, disclosure and
change as Firewalls, Data Encryption, physical controls on the access to Data Center and authorization controls on information access.
8.3 Essential sharing of information
8.3.1 Epay may disclose your information essential to the transactions such as your name, account number, contact details, address for
shipping or billing and other information that will help to upgrade the level of security and reliability of the transactions. If a
transaction is blocked, broken down or judged to be invalid, we will provide information on the failure. In order to assist the dispute
resolution, we will give the seller's address to the buyer, so that the buyer could return the goods.
8.3.2 The receiver of your information must not use it in anything irrelevant to the transaction such as direct merchandising without your
prior agreement. Sending unnecessary or threatening e-mails to customers will be considered as violation to our policies and user agreements.
8.3.3 Epay will not sell or release your personal information to third parties for their promotional targets without your expressed consent.
8.4 You are responsible for protecting your account information from being inappropriately disclosed to others.
8.5 You are responsible for protecting your passwords. You acknowledge, Epay is irresponsible for the indemnity for the loss caused by
passwords lost or misuse. You should neither release your passwords to anyone else, nor use the passwords owned by others. We consider any
logging-in users' accounts to be the act of the owners themselves. If you let anyone to use your passwords, we deem it to be the acts of
8.6 Information collection
The data collected by Epay is under the situation that clients have agreed and learned about it,all of the data are collected on the
purpose of offering better service to clients and all of the data is related to the service of Epay.
9.1 In connection with your use of our websites, your Epay accounts, the Epay services, or in the course of your interactions with Epay, other Epay customers, or third parties, you will not:
a. Breach this user agreement, the Epay Acceptable Use Policy, any other agreement between you and Epay, or violate any Epay policy.
b. Violate any law, statute, ordinance, or regulation.
c. Infringe Epay's or any third party's copyright, patent, trademark, trade secret or other intellectual property rights, or rights of publicity or privacy.
d. Sell counterfeit goods.
e. Act in a manner that is defamatory, trade libelous, threatening or harassing.
f. Provide false, inaccurate or misleading information.
g. Send or receive what we reasonably believe to be potentially fraudulent funds.
h. Refuse to cooperate in an investigation or provide confirmation of your identity or any information you provide to us.
i. Attempt to double dip during the course of a dispute by receiving or attempting to receive funds from both Epay and the seller, bank or card issuer for the same transaction.
j. Control an account that is linked to another account that has engaged in any of these restricted activities.
k. Conduct your business or use the Epay services in a manner that results in or may result in complaints, requests by buyers (either filed with us or card issuers) to invalidate payments made to you, fees, fines, penalties or other liability or losses to Epay, other Epay customers, third parties or you.
l. Credit reporting agencies showing in their risk assessments that your use of Epay services might be of high risk.
m. Use your Epay account or the Epay services in a manner that Epay or any other electronic funds transfer network reasonably believes to be an abuse of the network rules.
n. Allow your Epay account to have a negative Epay balance.
o. Disclose or spread users' information to third parties, or use it for promotion, without their expressed consent.
p. Send spam mails to users, or use Epay services to receive payments for sending or assisting to send spam mails to third parties.
q. Take any action that imposes an unreasonable or disproportionately large load on our infrastructure;
r. Facilitate any viruses, Trojan horses, malware, worms or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information;
s. Use an anonym zing proxy; use any robot, spider, other automatic device, or manual process to monitor or copy our websites without our prior written permission;
t. Use any device, software or routine to bypass our robot exclusion headers, or interfere or attempt to interfere with our websites or the Epay services.
u. Take any action that may cause us to lose any of the services from our Internet service providers, payment processors, or other suppliers.
v. Abuse (as a buyer or a seller) any of our dispute resolution procedure, or our user right.
9.2 You are responsible for the complaints, requests by buyers to invalidate payments made to you, fees, fines, penalties or other liability or losses resulted by your violation of this user agreement and (or) your use of Epay services. You consent to indemnities for any and (or) all of such liabilities and losses to Epay, other Epay customers, or third parties.
9.3 Our available actions:
If Epay believes that you've engaged in any of these activities, we may take a number of actions to protect Epay, its customers and others at any time in our sole discretion. The actions we may take include, but are not limited to, the following:
a. Terminate this user agreement and/or close or suspend your Epay account,
b. Refuse to provide the Epay services to you in the future.
c. Limit your access to our websites, your Epay account or the Epay services, including limiting your ability to pay or send money with any of the payment methods linked to your Epay account or restricting your ability to send money or make withdrawals.
10. Intellectual Property
10.1 “Epay.com” “Epay” and all logos related to the Epay services are either trademarks or registered trademarks of Epay or Epay’s licensors. You are not allow to copy, imitate, modify or use them without Epay’s prior written consent.
10.2 All page headers, custom graphics, button icons, and scripts are service marks, trademarks, and/or trade3 dress of Epay. You are not allow to copy, imitate, modify or use them without prior written consent.
10.3 You may use HTML logos provided by Epay for the purpose of directing web traffic to the Epay services. Any loss or damage (including direct, indirect or consequential loss or damage or loss of profits, business, revenue or opportunity) arising
from any delay or failure to carry out Epay Companys obligations under this Agreement.
3. Termination and Indemnity
We may block or terminate the account and the contract with any client immediately if we suspect any fraud or misuse of an Epay payment.
If we have other security concerns or we need to do so to comply with the law. The remaining account balance may be used as a compensation
for the losses due to damage to the image and reputation of the company. This comes into effect when it is suspected that Epay Policies and
requirements have been violated both intentionally or unintentionally.
You hereby indemnify and agree at all times to hold Epay unaccountable from and against all losses, demands, claims, damages, expenses
(including reasonable legal costs) and liabilities arising from any third party claim resulting from your use or misuse of the Epay payment system,
or for harm suffered directly or indirectly by Epay as a result of your breach or non-observance of your obligations under this Agreement.

4. Requirements for Merchant Approval
The Epay Service will not approve a merchant if:
The website or activity undertaken will be deemed oriented to any sensitive and negative subjects listed in the “Restricted Business Categories”
The merchant has not provided all the information required for KYC (Know Your Customer) purposes to the complete satisfaction of Epay.
All rights, licenses, permits and authorizations necessary to enable the merchant to operate the business and comply with all relevant laws and
regulations are not obtained. For gambling merchants this will include a valid gambling license issued by a recognized authority. All companies
will need to submit a copy of the Company registration documents (Certificate of Incorporation) and Company Statutes (Memorandum & Article of
Association) as a minimum.
There is significant derogatory background information about the merchant and/or any person, body or organization associated directly or indirectly
with the merchant. This will include directors, employees, partners, principals and shareholders. Epay has the right to request any information in
this regard from the appropriate sources including using credit reports, trade and bank references, criminal records, PEP, OFAC and other sanction
databases, personal and business financial statements and tax returns.
A valid URL address is not linked to a working website or will not exist prior to the merchant being activated. The URL must link directly to
web pages that contain information about the merchant’s service or products. Links that redirect through or to domains other than the one
specified in the Epay merchant account settings will not be accepted.
Epay is not given full and unfettered access to the merchant’s web site at any time as reasonably determined by Epay.
In the sole opinion of Epay, false, confusing or misleading statements are made directly or indirectly by the merchant or if there is a
failure to disclose a material fact about their programs, products or services, or any aspect there of.
The procedures and controls required by Epay, including Anti-Money-Laundering and Anti-Terrorist Funding controls, are not implemented.
5. Monitoring and Compliance
The Epay Security Department will, on an ad hoc basis, review live merchants to monitor compliance with the above guidelines.
Epay will suspend or terminate a non-complying merchant, subject to the terms of the merchant’s contract.
A Merchant must not be involved or associated with any activities or materials which may infringe, dilute, denigrate, or impair the goodwill
and/or reputation of the Epay brand.

Epay will not under any circumstances knowingly approve Merchants associated directly or indirectly with the following products or services:
Terrorism, Racism and Violence: products and associated websites which in any way promote violence or advocate violence against a target group.
A target group is distinguished by its race or ethnic origin, color, national origin, religion, disability, sex, age, veteran status or sexual
Body parts: promotion, sale or dealings of nature in body parts or human remains or the non-consensual mutilation of a person or body part.
Copyright unlocking devices: modchips or other devices designed to circumvent copyright protection.
Abusing copyright or counterfeit goods: All products and services presented by merchants must respect copyright and trademark law. Unauthorized or "bootleg"
copies of media, software, or other licensed or protected material will not be acceptable. In addition products that are replicas or imitations of designer
goods without the appropriate announcement; products without a celebrity endorsement that would normally require such an association, fake autographs, counterfeit
stamps, and other potentially unauthorized goods will also fall into this category.
Drugs, drug paraphernalia, and drug test circumvention aids: promotion of illegal drugs and drug accessories, including herbal drugs such as salvia and magic

Payment Services intended for a beneficiary from a website offering gambling services where it is strictly forbidden for citizens or residents of that country
to receive such payments from such websites.
Schemes that do not fully verify the identity of all parties involved and do not allow Epay full visibility and access to information relating to the entire
transaction associated with a Epay.
Merchant is hereby informed about all the requirements and agreements of using Epay global payment services, accepts them and agrees to follow
and incorporate them into the business.
Merchant agrees to promptly, but not later than 2 working days, notify Epay using the Support Desk service of any changes in the status, type,
category or other information related to the business.
Epay Secured Transaction Service Agreement
The secured transaction is a function developed by Epay to solve the trust problem occurred in the transaction between the two unfamiliar parties, as the intermediate guarantee party, Epay does not charge the commission fee but guarantee the security of the transaction according to the fair and equitable statements with factual evidence so that the huge valued fund transaction no longer lacks security.
Article 1 General
(1) "Epay Secured Transaction Service Agreement" (hereinafter referred to as "this Agreement") is a valid contract established for the use of secured transactions (hereinafter referred to as "secured transactions" ") and related matters between Epay Global Limited (hereinafter referred to as "Epay") and Epay User (hereinafter referred to as "User" or "You"). (1) You have been acknowledged that the use of the Service means your true will, and you are solely responsible for the authenticity and validity of the instructions issued during the use of the Service, please know the order cannot be changed or revoked, but you undertake that all risks of Epay's operation in accordance with your instructions will be borne by you.
(2) You agree to undertake that you will not to use the Service to engage in any illegals, infringe the purpose of this Agreement or to infringe the rights of other third parties, otherwise Epay has the right to immediately terminate the provision of the Service without any liability; if the behavior causes losses to Epay, you shall be fully liable.
(3) You authorize Epay to retain the relevant information data formed during your use of the Service or Epay's termination of the Service, and the authorization is irrevocable.
(4) You agree that the descriptions and rules of the Epay website regarding secured transactions are integral parts of this Agreement.
(5) When you use this service provided by Epay, you must also abide by the Epay User Agreement and related subsidiary rules published by Epay website from time to time, otherwise the responsibility will be borne by you.
(6) You clearly know that if you pay the payer through the “secured transaction” method, the payment will arrive at the Epay account immediately. The funds will be temporarily frozen by Epay official and will be remitted to the payee’s account after the second confirmation.
(7) You understand and agree that when you have a transaction dispute with the payer, you can file an application for rights protection with Epay only for the following conditions:
1. You must be a real name verified Epay user.
2. Within rights protection period, that is, within 15 days after your payment;
3. Payer and payee cannot agree on a transaction dispute.
(8) You understand and agree that Epay will handle your dispute with the payer in accordance with the rules of this agreement after receiving your application for rights protection, but it does not guarantee that Epay's processing results will meet your expectations.
(9) After you have successfully defended your rights, Epay will deduct the corresponding amount from the payer's Epay account and return it to your Epay account for payment.
(10) If you have any questions, suggestions or comments about Epay secured trading services, you can call Epay customer service or log in to Epay website for consultation and complaint.
Article 4 Epay's rights and obligations
(1) Epay is obligated to keep confidentiality of your registration information, but Epay has the right to provide relevant information to Epay's supervisory authority when necessary.
(2) Epay is technically obliged to ensure the safe, effective and normal operation of the secured trading system to ensure the smooth use.
(3) Epay may use your data and transaction records within the scope of the laws, regulations and your authorization, and you hereby confirm that Epay has the right to use all the information generated during the use of the Service.
(4) Epay does not actively intervene in the dispute between you and the payer before you file an application for rights protection to Epay.
(5) Epay has the right to refuse the following applications:
1 Your application has exceeded for the protection period;
2 You have been involved in the accepted application for judicial authority;
3 Other transactions that are difficult to make specific responsibility divisions based on the complex circumstances of the transaction dispute.
(6) Epay has the right to process your application for rights protection to Epay in accordance with this Agreement and its subsidiary rules, as well as the Epay User Agreement, and has the right to decide whether to return the funds to you or to unfreeze the funds in the Epay account and transfer it the payer’s account.
(7) Except for additional rules provided in this Agreement, Epay may terminate the provision of the Service to you unilaterally with advanced message to you or post on the website, and shall not be liable for any compensation. After Epay terminates the provision of this service, if it is found that you have previously violated the law or violated the purpose of this agreement, and caused losses to Epay, Epay can still request you to bear the corresponding liability and reserve the right to resolve through judicial channels.
(8) Epay is responsible for providing you with advisory services for secured transactions, and publishes features, usage rules, etc. on the Epay website.
Article 5 Amendment of the agreement
(1) Epay will have the right to modify the relevant terms of this Agreement at any time. Once the relevant content changes, Epay will prompt you to modify the content by email or website announcement.
(2) If you disagree with Epay's changes to the terms and conditions of this Agreement and its subsidiary rules, you should immediately stop using the service provided by Epay. If you continue to use the services provided by Epay, you are deemed to have accepted and acknowledged the changes to the terms of this Agreement and its accompanying rules.
Article 6 Settlement of disputes
In the process of fulfilling this agreement, if both parties have disputes, they shall be resolved through negotiation. If the negotiation fails, either party may arbitrate to the Hong Kong International Arbitration Centre.
Article 7 Interpretation of the Agreement
The final interpretation of this agreement is enjoyed by Epay; if the law does not expressly stipulate, the business rules and common business practices established by Epay shall apply. This Service Agreement does not stipulate that it is performed in accordance with the Epay User Agreement and related subsidiary rules; if this Agreement conflicts with the Epay User Agreement and related subsidiary rules, this Agreement shall prevail.
Article 8 Complete Agreement
This Agreement consists of the terms of this Agreement and other rules published on this website. Relevant nouns may be referenced by each other. If there is any different understandings, the terms of this Agreement shall prevail.
By understanding and agreeing to this Agreement, you understand and agree to the contents of all the components of this Agreement. Once you use the Service, you and the Company are bound by all the components of this Agreement.
Matters not agreed in this Agreement are supplemented by the Epay User Agreement and related subsidiary rules published by the Epay website from time to time.
